Federal Regulatory Agencies under second-order control: evolution of the quality of brazilian Federal Court of Accounts (TCU) deliberations in the waterway and land transport sectors
Abstract
The core activities of Federal Regulatory Agencies have been supervised by the Brazilian Federal Court of Accounts (TCU), which is commonly called second-order control. Some academic works and part of the specialized press claim that external control has acted as a “second-order regulator”, replacing the attributions of federal regulators. This context would require a self-restraint on the part of the Court. By restricting to the waterway and land transport infrastructure sectors, this study investigates the importance of the Brazilian Supreme Audit Institution (SAI) in more than a dozen complex cases and the possible beneficial effects of its recent Normative Resolution 315/2020, by the inductive method. Is based in a broad technical view to promote good public governance, increasing the participatory construction of the Court's deliberations and contributions to social control, without losing sight of the fact that discretion does not mean arbitrariness.

Engenheiro Civil pela Universidade Federal de Sergipe, 2004. Mestrado na Escola Politécnica da Universidade de São Paulo (USP), 2006. Foi Especialista em Regulação da Agência Nacional de Energia Elétrica (ANEEL) por 8 anos. Auditor Federal de Controle Externo do Tribunal de Contas da União (TCU) desde 2015. Exerceu o cargo de Diretor de mobilidade urbana, e de Especialista sênior na Secretaria de Fiscalização de Infraestrutura urbana e na Secretaria Extraordinária de Operações Especiais em Infraestrutura. Atualmente desempenha suas funções na Secretaria de Fiscalização de Infraestrutura Portuária e Ferroviária.

Portuária e Ferroviária.
